The outdoor advertising industry in the U.S. looks likely to receive a welcome boost in its continuing battle with anti-digital activists, after South Dakota law-makers approved a bill that will prevent cities from banning digital billboards.

The state’s senate and house of representatives have both passed the bill, which the governor is now expected to sign into law.

It prevents any community from unilaterally restricting “any advertising technology” provided that the state allows it. However, municipalities will be able to put limits on brightness and dimensions, and to “reasonably” regulate outdoor advertising so long as they don’t impose tighter restrictions than those set by the state.

The bill also prohibits flashing lights except on billboards providing information such as time and temperature.

Rapid City, the state’s second-largest community, last year banned new digital billboards after a referendum in which two thirds of voters supported the ordinance.

Close to Mount Rushmore, the Black Hills and the Badlands National Park, it is an important tourist destination, and objectors felt the digital billboards diminished the atmosphere. A Republican senator said that visitors frequently complained.
